by the Internal Revenue Service on October 24, 2008, effective as of the date of incorporation

Mission Statement

Giving Tree NYC is a New York non-profit corporation that supports the musical band, The Giving Tree.  The Giving Tree Foundation is the charitable expression of Giving Tree NYC.  The band, The Giving Tree, donates all of its net earnings to bona fide 501(c)(3) tax-exempt charities. By "net earnings" we mean what we get paid to play performances, what people donate directly to The Giving Tree Foundation, and what we earn selling The Giving Tree t-shirts, hats, and CDs, less only the "reasonable and necessary" expenses thereof.

There are three ways Giving Tree NYC determines to which charities to give some or all of its net earnings:

• Through The Giving Tree Foundation, Giving Tree NYC may, from time to time, distribute net earnings to bona fide 501(c)(3) tax exempt charities chosen by members of The Giving Tree.
  

• Giving Tree NYC may also, from time to time, partner with specific performance venues to benefit specific bona fide 501(c)(3) tax exempt charities. On those occasions, all net earnings will be distributed to the selected bona fide 501(c)(3) tax exempt charity or charities.
  

• Giving Tree NYC may also, from time to time, partner with specific bona fide 501(c)(3) tax exempt charities to produce special events at which The Giving Tree will perform. On those occasions, all net earnings will be distributed to the selected bona fide 501(c)(3) tax exempt charity or charities and to The Giving Tree Foundation.
